Terms of Use
MEMBERS’ RIGHT TO CANCELYou, the buyer, may cancel this agreement, without any penalty or obligation, at any time prior to midnight of the third business day following the date of this contract (the day you pay for a membership), excluding Sundays and holidays. To cancel this agreement, send an email to Levelswipe at support@levelswipe.com from the email address on your account, stating that you, the buyer, are canceling this agreement, or words of similar effect. All money you paid will be refunded within 10 days of our receiving your notice. Notice of cancellation: any written notice that reaches us works, for example an email that says “I’m canceling my Levelswipe membership.”
These Terms of Use are the agreement between you and Levelswipe (“Levelswipe,” “we,” “us”). Levelswipe is run by one person in California, USA, so “we” really means one guy. By using levelswipe.com, creating an account or buying a membership, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Levelswipe.

1. Who can use Levelswipe
To use Levelswipe, you must:
- be at least 18 years old;
- be able to make a binding contract, and not be barred from using Levelswipe by any law;
- never have been convicted of a sex crime or a violent crime, and not be required to register as a sex offender anywhere;
- have only one Levelswipe account (one per phone number), and not have been removed from Levelswipe before.
You also may not use Levelswipe to take part in, help or promote human trafficking or sex trafficking of any kind, including sexual exploitation, or to abuse anyone, or aid, abet or encourage the abuse of anyone, including the sexual abuse or exploitation of children. Breaking this rule ends your account. Section 7 has the full community rules and explains how we report these crimes.
2. Your account and the three checks
- Give true information: your real first name, your real birthdate, and photos that clearly show you.
- Keep your password private. You’re responsible for what happens on your account. Tell us right away if you think someone else is using it.
- Before you can chirp, see your Chorus, match or message, and before anyone can see your profile, you need to finish three checks: confirm your email, pay for a membership, and confirm your phone number. Your profile stays hidden until all three are done.
- To confirm your phone, we text you a one-time code. Standard message and data rates may apply. We don’t send marketing texts.
- Your Wheel needs at least one photo and a rough location, because people are sorted by distance.
3. How Levelswipe works
- No algorithm. Your Wheel shows everyone who fits your filters (who you want to see, an age range and a distance), closest first, then newest. Nobody is ranked, boosted or hidden, and there are no boosts or super likes to buy.
- Chirps. You answer each person with a tap: one chirp for yes, or two chirps to pass. It’s a match only when you both chirp yes. A yes can’t be taken back, but you can unmatch or block at any time.
- Daily chirps. Every member gets the same number of yes chirps in any 24 hours (the app shows how many you have left). Each one comes back 24 hours after you use it. Chirping back at someone who already chirped at you doesn’t use one up. Passing is always free.
- The Chorus shows everyone who chirped at you, whatever their gender, age or distance, unless you turn on a Chorus filter.
- Other members only see roughly how far away you are, as a band like “1–5 mi”. Never an exact distance or a map.
- If you don’t use Levelswipe for 7 days, your profile is paused and taken off the wheel. Nothing is deleted, and any activity brings you back.
- Levelswipe introduces people. It doesn’t promise you matches, dates or a relationship, and it doesn’t vouch for anyone.
- We may change, add or remove features over time. When that affects these terms, we’ll update them (see section 10).
4. Membership and payment
- A membership is one flat fee to create your profile for a fixed length of time: $3 for 3 months or $6 for 6 months (US dollars). The price is always shown before you pay.
- No auto-renew. A membership simply ends when its time is up. We never charge you again unless you choose to buy another one. Buying again adds the new time on top of what you have left.
- Everything is included: your daily chirps, unlimited matches and messages, and seeing everyone who chirped at you. There are no upgrades.
- Paying before launch. Before Levelswipe opens, you can create your profile and buy either membership at the same price. Your months start on launch day, the day Levelswipe opens to members, not on the day you pay, and we’ll email you when that happens. Until launch you can set up your profile, but nobody can see it and nobody can chirp. (Before October 17, 2026, we also sold an “early membership” of $3 for 6 months before launch. It’s no longer sold; section 5 explains its refund terms for those who bought one.)
- Your membership starts when your payment goes through (or on launch day, if you paid before launch) and runs on the calendar. Being paused for inactivity doesn’t pause or extend it.
- Payments are handled by Stripe. Levelswipe never sees or stores your card number.
- We sometimes give memberships for free, for example to testers. A free membership has no cash value and can’t be refunded.
5. Cancellations and refunds
To cancel, email support@levelswipe.com from the email address on your account. When you cancel, your membership ends right away. Your account stays unless you delete it. Refunds go back to the card you paid with, within 10 days of your request.
- First 3 business days: full refund. See “Your right to cancel” at the top of these terms.
- Early memberships ($3 for 6 months, sold before launch until October 17, 2026): no refunds after the first 3 business days. Once your 3-business-day right to cancel has passed, the early-member price is final, including before launch day, except in the cases below where the law requires a refund (death or disability, moving). The “$3 back” for 6-month memberships doesn’t apply to early memberships.
- 6-month memberships, first 3 months: $3 back. Cancel within 3 months of the day you paid, and we’ll refund $3. The 3-month membership has the 3-business-day full refund only.
- Otherwise, payments are final (after 3 business days for a 3-month membership, after 3 months for a 6-month one), except in the cases below.
- Death or disability. If, because of death or disability, you can’t use the rest of your membership, you or your estate can ask for a refund of the unused part, worked out by the day. “Disability” means a condition that keeps you from using Levelswipe while it lasts, confirmed in writing by a doctor you choose and pay for. If the disability is expected to last less than 6 months, we may extend your membership by 6 months at no charge instead of refunding.
- Moving. If the law where you live gives you the right to cancel or get a refund when you move, we’ll honor it.
- New York residents can put a membership on hold for up to 1 year. Email us to start or end a hold, and we’ll add the held time back to your membership.
- Deleting your account doesn’t cancel a refund you’re owed. Email us about it before or after you delete.
- If you think a charge is wrong, please email us before disputing it with your bank. We’ll sort it out quickly.
- If we close your account because you broke these terms, you won’t get a refund, except where the law requires one.
6. Safety
LEVELSWIPE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS.
We confirm each member’s email address, phone number and payment. We don’t check identities or criminal records, and we can’t promise anyone is who they say they are.
- You’re responsible for how you deal with other members, online and in person. Please read our safety tips before you meet anyone. The basics: anyone who is able to commit identity theft can also falsify a dating profile; there is no substitute for acting with caution when communicating with any stranger who wants to meet you; never include your last name, email address, home address, phone number, place of work or other identifying information in your profile or first messages, and stop communicating with anyone who pressures you for personal or financial information; and if you meet in person, tell a friend or family member where you’re going and when you’ll be back, provide your own transportation, never agree to be picked up at home, and meet in a public place with many people around.
- Use Block and Report in the app (the ⋯ button on a profile or in a chat), or email us. We review every report and can remove anyone who breaks these terms.
- In an emergency, call 911 first.
7. Community rules (Acceptable Use Policy)
These rules are Levelswipe’s Acceptable Use Policy. They apply to your profile, photos, chirps and messages, to what you do in Bird Town, and to how you treat members you meet. On Levelswipe, don’t:
- use Levelswipe if you’re under 18, or help anyone under 18 join;
- take part in, help or promote human trafficking or sex trafficking of any kind, including sexual exploitation and forced labor;
- abuse anyone, or aid, abet or encourage the abuse of anyone, including the sexual abuse or exploitation of children;
- commit, threaten or promote sexual violence or any other violence against anyone;
- harass, threaten, bully, stalk or intimidate anyone, or post hateful content about anyone’s race, ethnicity, religion, disability, gender, sexual orientation or other protected trait;
- post nudity or sexually explicit content on your profile, or send sexual messages or images to anyone who hasn’t clearly said they want them;
- share, or threaten to share, intimate or sexual images of anyone without their consent;
- scam or defraud anyone, or ask anyone for money, gifts, crypto or financial information, or pitch investments;
- advertise, sell or recruit, or offer or ask for paid sexual services;
- pretend to be someone else, or lie about your age;
- post photos of other people without their permission, or of children on their own;
- share another member’s personal information or private messages without their permission;
- use Levelswipe for anything illegal;
- use bots, scrapers or other automated tools, create fake or extra accounts, or share or sell your account;
- try to hack, overload or get around any part of Levelswipe, including the three checks.
Bird Town (the Community). Bird Town is where members’ birds hang out together in shared rooms, like the café, the beach and the park. Every bird wears a tag that says Single, Taken or Married. Taken is agreed between two members (one asks, the other says yes) and takes both off the Wheel; either one can go single at any time, which ends it for both (an engagement or a Bird Town marriage too) and tells the other. A bird that says Taken or Married is there for friends. These rules apply there too. You can only use the preset phrases and emotes, so please don’t use them, your bird or its name to harass, follow, crowd or pressure anyone. Tap a bird and then ⋯ to block or report it. We can also take anyone out of Bird Town, for a while or for good, without closing their account. Nothing in Bird Town can be bought: everyone gets the same birds, rooms and moves.
Dates, games and weddings in Bird Town. You can invite one of your mutual chirps on a date in Bird Town (if your bird says Taken, only the person you’re taken with), now or up to a week ahead. They can say yes or not now, and either of you can call it off or leave it at any time, which ends it for both. A date is a private copy of the place for just the two of you: nobody else can see it, join it or watch, and your chat sits beside it. These rules apply on dates too, and you can block or report from there. The games at Game Night are just for fun: there are no prizes, no bets, no leaderboards and nothing to win or buy, and a score lasts one game. The same goes for chirp rooms: parties of 2 to 4 members, made in the lobby behind the Chirp & Sip back door, that play the Garage’s co-op game (Lights Out) together. A party isn’t a date — any member can party with any other, whatever their tags say — and these rules apply there too: preset phrases only, block and report work the same (blocking someone in your party takes them out of it), and nothing about a game is kept once it ends. Once you’ve been taken together for 12 months, either of you can propose on a sunset walk at the beach and, after a yes, you can have a wedding there. The beach is open to everyone, so members there can watch the wedding and throw petals. A Bird Town wedding is a celebration inside the app, not a legal marriage, and it has no legal effect.
We can remove any account that breaks these rules. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children, as federal law requires, and may report other crimes, such as human trafficking, to the police. See how we handle law enforcement requests.
8. Your content
- Your photos, bio and messages stay yours. You give Levelswipe permission to store them, process them (for example, to shrink photos) and show them to other members as needed to run the service. This permission ends when you delete them or your account, except for copies kept for a limited time in backups, to handle a report, or where the law requires us to keep them.
- Only post things you have the right to post.
- We can remove content that breaks these terms. We don’t read your messages, except to look into a report, to protect someone’s safety, or when the law requires it.
9. Ending your account
- You can delete your account any time in Settings. This permanently removes your profile, photos, chirps, matches and messages.
- We may suspend or delete your account if you break these terms, put other members at risk, or if the law requires it. Where it’s safe and reasonable, we’ll tell you why.
- Appeals. If we remove your account and you think we got it wrong, email support@levelswipe.com from the email address on the account within 30 days. We’ll take a fresh look and reply within 7 days. If we reverse our decision, we’ll lift the ban so you can sign up again. If we don’t, the removal is final.
- If we remove an account because we believe it was fake or used to defraud members, we’ll email a warning to the members who exchanged messages with it, as the law requires. We may also keep a hashed record of a removed account’s email address and phone number so it can’t sign up again.
10. Changes, and if Levelswipe shuts down
- We may update these terms. We’ll post the new version here with a new date, and we’ll email members about important changes before they take effect. Changes won’t take away a refund you’re already owed or change the price of a membership you’ve already paid for. If you keep using Levelswipe after a change takes effect, you accept it.
- If Levelswipe ever shuts down, we’ll give at least 30 days’ notice by email and on this site.
11. Rights of members in certain states
Some states give dating-service members extra rights. If you live in one of them, these apply to you on top of everything above, and we’ll honor them wherever you live if you ask.
- Hold. New York members can put a membership on hold for up to one year by emailing us; the held time is added back to the membership. We offer the same to anyone.
- Moving. Levelswipe works anywhere in the United States, so moving doesn’t stop you using it. If you move to a place where it isn’t useful to you and the law of your state (for example Illinois, New York, North Carolina or Ohio) gives you a right to a refund or alternative when you relocate, email us and we’ll provide a refund of the unused part of your membership, worked out by the day.
- Your information when you leave. When your membership ends or you delete your account, your personal information is deleted from our systems as described in the Privacy Policy (we don’t keep paper files, so there is nothing to mail back). On request, we’ll confirm the deletion in writing.
- Cancellation by mail. You may send any notice under these terms by email to support@levelswipe.com. If your state requires us to accept cancellation by certified or registered mail, email us and we’ll give you a mailing address.
New York members: Dating Service Consumer Bill of Rights (General Business Law §394-c). As a purchaser of a dating service in New York, you have the following rights: (1) no dating-service contract may require you to pay more than $1,000 or run longer than two years (the $1,000 limit doesn’t apply to an online service whose terms are one year or less, which is true of Levelswipe’s 6-month memberships); (2) the seller may not require you to buy any additional product or service as a condition of the contract; (3) a contract costing more than $25 must state the minimum number of referrals the service will furnish each month, and if the service fails to do so for two successive months you may cancel and receive a refund (Levelswipe has no monthly referral minimum: everyone who fits your own filters is shown to you, with no limit); (4) your contract must specify the distance you are willing to travel, except for a service offered on a regional, national or global basis such as Levelswipe, where you set your own distance filter at any time; (5) the provider must have an established policy for when you move outside the area it serves (see “Moving” above); and (6) if the provider breaks the contract, you may bring a court action. You also have the right to place your membership on hold for up to one year, and to have your personal information returned or destroyed when the contract ends.
12. Legal stuff
- No guarantees. Levelswipe is provided “as is” and “as available.” To the extent the law allows, we don’t promise that it will always be available or error-free, or that you’ll find a match. We aren’t responsible for what members say or do, on or off Levelswipe.
- Limit on liability. To the extent the law allows, Levelswipe isn’t liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or $50. Some places don’t allow these limits, so they may not apply to you. Nothing here limits liability that the law doesn’t allow us to limit.
- If someone makes a claim because of you. If someone makes a claim against Levelswipe because of content you posted or because you broke these terms, you agree to cover our reasonable costs, to the extent the law allows.
- Disputes. Please contact us first; most problems can be fixed by email. These terms are governed by California law. Any dispute will be handled in the state or federal courts in Ventura County, California, except that either of us may use small claims court. This doesn’t take away rights you have under the laws of the state where you live.
- The whole agreement. These terms and the Privacy Policy are the whole agreement between you and Levelswipe. If any part can’t be enforced, the rest still applies. If we don’t enforce a part right away, we haven’t given it up.
- The name. Levelswipe™ and the Levelswipe logo are trademarks. Please don’t use them in a way that suggests we endorse you.
13. Contact and copies
Levelswipe is operated by Gabriel S. Burt, doing business as Levelswipe, in Ventura County, California. Email support@levelswipe.com about anything in these terms.
